Terms of Use
These Terms of Use (the “Terms”) govern your use of the mobile games published by PaciPaci (the “Developer”, “we”, “us”) — including Ishizumi and Nagomi (each a “Game”).
By downloading, installing or playing a Game, you agree to these Terms. If you do not agree, please do not use the Game.
- The Games are free to play and provided as is.
- You get a personal, non-transferable licence to play — not ownership of the Game.
- There are no accounts, no purchases, and no user-generated content.
- Your distribution platform's terms (e.g. Google Play) apply alongside these.
1. Licence
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and play the Game on devices you own or control, for your own non-commercial entertainment. All rights not expressly granted are reserved.
2. What You May Not Do
- copy, sell, rent, sublicense or otherwise distribute the Game;
- modify, reverse-engineer, decompile or disassemble the Game, or create derivative works from it, except to the extent such restriction is prohibited by applicable law;
- circumvent, disable or interfere with any part of the Game, including its advertising, or use cheats, automation or modified clients to manipulate scores;
- use the Game for any unlawful purpose, or in a way that infringes the rights of others.
3. Intellectual Property
The Game and all of its content — code, artwork, sound, music, text and name — are owned by the Developer or its licensors and are protected by copyright and other laws. Third-party components (such as the Godot Engine, the Google Mobile Ads SDK, and any licensed music included in a Game) remain the property of their respective owners and are used under their own licences.
4. Advertising
The Games are free and are supported by advertising served through Google AdMob. Ads are optional rewarded ads: you choose whether to watch one in exchange for an in-game benefit. We do not control which specific ads are shown and are not responsible for the content of third-party advertisements or for any products or services they promote. Handling of data in connection with ads is described in each Game's privacy policy.
5. No Purchases
The Games contain no in-app purchases and no real-money transactions. Any in-game points, scores or items have no monetary value, cannot be exchanged for money, and may be reset or lost — for example if you uninstall the Game or clear its data. Game progress is stored only on your device; we keep no backup and cannot restore it.
6. Availability and Updates
We may update, change or discontinue a Game — or any of its features — at any time, without notice and without liability. We do not guarantee that a Game will be available at all times, will run on every device, or will be free of errors.
7. Disclaimer of Warranties
The Games are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. You use the Games at your own risk.
8. Limitation of Liability
To the fullest extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or in connection with your use of or inability to use a Game.
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including your statutory rights as a consumer.
9. Health and Safe Play
Take regular breaks while playing. If you have a history of photosensitive epilepsy or similar conditions, consult a doctor before playing. Do not play in situations where distraction could be dangerous.
10. Age
The Games are intended for a general audience and are not directed to children under the age of 13 (or the equivalent minimum age in your jurisdiction). If you are a minor, please make sure a parent or guardian agrees to these Terms on your behalf.
11. Privacy
Your use of a Game is also governed by that Game's privacy policy, available from the index page.
12. Third-Party Platforms
Games distributed through Google Play are also subject to the Google Play Terms of Service. In the event of a conflict, the platform's terms govern your relationship with that platform, and these Terms govern your relationship with the Developer. The platform provider is not a party to these Terms and has no obligation to provide support for a Game.
13. Termination
This licence ends automatically if you breach these Terms. You may end it at any time by uninstalling the Game.
14. Governing Law
These Terms are governed by the laws of the Czech Republic, without regard to its conflict-of-law rules. If you are a consumer resident in the European Union, you also benefit from any mandatory provisions of the law of your country of residence.
15. Changes to These Terms
We may revise these Terms from time to time. The revised version will be posted at this address with a new “Last updated” date. Continued use of a Game after the changes take effect constitutes acceptance of the revised Terms.
